Dateline Resources Limited (ASX:DTR)(OTCQB:DTREF)(FSE:YE1) and the US Government have separately sought relief from the United States Court of Appeals for the Ninth Circuit after a California District Court decision. Their motions ask the court to pause a preliminary injunction while the appeal is considered, which could allow work at Dateline’s Colosseum project to resume during that period.

#Ninth Circuit panel to review stay request

A three-judge Ninth Circuit panel will consider the stay request afresh. The submissions address the factors the court is required to assess, including the appeal’s merits, the harm attributed to the injunction, the limited effect of restarting work and the national interest.

Dateline and the US Government have submitted that each of those factors supports granting a stay. The motions concern the period pending appeal and do not represent a final resolution of the underlying case.

#Dateline’s position on the Colosseum operating plan

Dateline maintains that the Plan of Operations approved by the Bureau of Land Management in 1985 is a valid existing right. The company says that right continued after the creation of the Mojave National Preserve and that the National Park Service recognised the position in 1995, 2024 and again in April 2025.

Dateline said it will provide further market updates as the legal proceedings develop.

#Background on Dateline Resources

Dateline Resources is an Australian mining and exploration company focused on North America. It owns 100% of the Colosseum Gold-REE Project in California. The project is in the Walker Lane Trend in East San Bernardino County, 10km north of the Mountain Pass rare earth mine.

Drill testing of the project’s HREE potential has commenced, while a Bankable Feasibility Study was completed in May 2026.

The company has also acquired the Argos Strontium Project in San Bernardino County. The announcement describes the deposit as reportedly the largest strontium deposit in the U.S., with previous celestite production grading 95%+ SrSO 4.

In March 2026, Dateline consolidated the Music Valley Heavy Rare Earth Project in Riverside and San Bernardino Counties. The company said the area has known HREE mineralisation identified through USGS rock chip sampling but has not undergone modern exploration techniques.
