Brazil Potash Corp. has reported a procedural court filing concerning its Autazes potash project in Amazonas State, Brazil. The application was submitted by Brazil’s Federal Public Defender’s Office, acting for certain indigenous organisations opposed to the project, and the company said it has not yet received formal service.
#Application Filed Within Existing Litigation
Brazil Potash said it learned of the application through publicly available court records. Known as a Suspensão de Tutela Provisória, the filing was made directly to the President of Brazil’s Supreme Federal Court.
According to the company, the filing is not a separate lawsuit and does not present new allegations or underlying facts. Instead, it is a procedural request connected to a Public Civil Action first brought by Brazil’s Federal Public Prosecutor’s Office in December 2016.
The application seeks to reverse recent decisions from the Federal Regional Court of the First Region, or TRF-1, that favoured Brazil Potash and the Indigenous Mura Council. It also asks for installation work connected with the Autazes Project to be suspended.
#Previous Court Rulings Cited by the Company
Brazil Potash said the matters raised in the application have already been considered extensively by Brazilian federal courts. The company pointed to earlier TRF-1 decisions concerning the Indigenous Mura Council’s status as the representative body for Mura communities in the municipality of Autazes.
The company also said the court had recognised the indigenous consultation process as consistent with United Nations International Labour Organization Convention No. 169. It said the process was carried out under judicial supervision using a protocol developed by Mura communities.
Brazil Potash said the consultation lasted more than six years and included over 35 indigenous villages. It culminated in an assembly where approximately 90% of participating communities voted to continue the project.
#Prosecutor General’s Office Issues Procedural Opinion
On July 9, 2026, Brazil’s Office of the Prosecutor General issued an opinion advising that the application should not proceed to a hearing on its merits.
The opinion stated that the Federal Public Defender’s Office did not have standing to bring the application and that the procedure used was not suitable for revisiting factual matters and evidence. Brazil Potash said this position is consistent with its own assessment of the filing.
#Company Reviewing Filing
Brazil Potash said the filing has not altered the legal position of the Autazes Project or the status of its environmental licences, which the company says remain in force.
The company and its external Brazilian legal advisers are reviewing the application and preparing a response. Brazil Potash said it plans to defend its position and considers the filing another procedural step in existing litigation rather than a new proceeding or substantive challenge.
The company said it will issue additional updates as warranted.
