US Court Reserves Decision on Colosseum Injunction Stay
The US District Court for the Central District of California has not yet ruled on applications seeking to suspend the August 2026 preliminary injunction affecting Dateline Resources’ Colosseum site.
Dateline Resources Limited (ASX:DTR, OTCQB:DTREF, FSE:YE1) is awaiting a decision from the United States District Court for the Central District of California on applications seeking a stay of the August 2026 preliminary injunction affecting its Colosseum project. The hearing took place on 26 October 2026 (US Pacific time), and the Court has taken the applications under submission.
Colosseum Rare Metals, Inc. (CRM), Dateline’s wholly owned subsidiary, and the Federal Defendants—the US Department of the Interior and the National Park Service—both applied for a stay pending appeal.
CRM also asked the Court, as an alternative, to require the plaintiff to provide security for losses incurred by CRM while the injunction remains in force.
During the hearing, the parties addressed whether the District Court had authority to change the injunction while an appeal was underway. The issue had been raised in a tentative ruling issued before the hearing, but the Court did not adopt that ruling at the conclusion of the proceedings.
The Court also requested information about the timetable for the substantive trial court case before taking the applications under submission.
CRM and the Federal Defendants have both appealed the injunction and sought a stay. The appeal itself is continuing separately from the stay applications.
If the District Court declines the applications, the parties may seek a stay from the Ninth Circuit Court of Appeals. Dateline said the Ninth Circuit would consider such an application afresh.
Operations at the Colosseum site remain suspended under the injunction. Dateline said its position remains that the Plan of Operations approved by the Bureau of Land Management in 1985 is a valid existing right that survived the creation of the Mojave National Preserve. The company said the National Park Service recognised that position in 1995 and again in April 2025.
Dateline said it will update the market when the Court’s decision is received.
Dateline Resources is an Australian company focused on mining and exploration in North America. It owns 100% of the Colosseum Gold-REE Project in California, including the Colosseum Gold Mine, which is located 10km north of the Mountain Pass rare earth mine.
The company said drill testing of the high heavy rare earth element potential at Colosseum has commenced, and that a Bankable Feasibility Study for the project was completed in May 2026.
Dateline has also acquired the Argos Strontium Project in San Bernardino County, California, and consolidated the Music Valley Heavy Rare Earth Project in Riverside and San Bernardino Counties in March 2026.
